Terms of Service

Farmsieis a marketplace that connects people buying and selling farm goods. We are not a party to any transaction. We do not grow, inspect, store, handle, or deliver any goods, and we don't set prices.

Provide accurate information and keep your login secure. You're responsible for everything that happens under your account. You must be old enough to form a binding contract where you live.

You're responsible for what you list, offer, and agree to. Descriptions, quantities, prices, and availability must be accurate. When an offer is accepted, that's an agreement between you and the other user — not with us.

Payment works one of two ways:

• Cash / in person. For farms that have not enabled card payments, you arrange payment directly with the seller (cash, Venmo, etc.) at pickup or delivery. Farmsie does not process or hold that payment, and there is no escrow or refund protection — pay when you have the goods.
• Card / escrow. For farms that have enabled card payments, your card is charged at checkout through our payment processor, Stripe, and the funds are held by Stripe until the hand-off is confirmed (or the order auto-completes a few days after), then paid out to the farm. Card details go directly to Stripe; Farmsie never stores your card number.

Payments and payouts are handled by Stripe and are subject to the Stripe Connected Account Agreement. Farmsie facilitates the transaction and does not itself take custody of your funds. Any Farmsieservice fee will be disclosed before you pay. Farmsieis a venue and is not a party to any sale: we don't guarantee that any payment will be made, that goods will be delivered, or that any transaction will be completed.

For a card/escrow order, you can cancel before the hand-off for a full refund. If something goes wrong, use "Report a problem" on the order — this freezes the auto-release and sends the order to us to review. We aim to respond within about 3 business days and will either release the funds to the farm or refund you based on the information both sides provide. Our decision on releasing or refunding held funds is final for the purpose of the escrow. For cashorders we don't hold any money, so refunds are between you and the seller. Chargebacks initiated with your bank may lead to account suspension where we believe they're abusive.

You are responsible for determining, collecting, and remitting any taxes on your sales, and for your own income-tax reporting. Where required, Stripe or Farmsie may report payout totals to tax authorities (for example, a Form 1099-K) and may ask sellers for tax information to enable payouts.

You are solely responsible for following all laws that apply to producing, selling, labeling, and transporting food where you operate — including licensing, cottage-food rules, and regulations for items like raw milk, eggs, meat, and produce. Farmsie does not verify the safety, quality, or legality of any listing. Buy and sell at your own risk and use good judgment.

Don't use Farmsie to break the law, defraud or harass others, list prohibited or unsafe items, or abuse the platform (for example, scraping, spamming, or interfering with the service). We may remove content or accounts that do.

You keep ownership of the photos and text you post. You grant Farmsie a non-exclusive, royalty-free license to host, display, and distribute that content as needed to operate and promote the marketplace.

Respect others' intellectual property — only post content you have the right to. If you believe content on Farmsie infringes your copyright, email us at [email protected]with enough detail to identify the work and the infringing material, and we'll respond to valid notices, including by removing the content where appropriate.

The service is provided "as is" and "as available" without warranties of any kind. We don't warrant that the site will be uninterrupted or error-free, or that any listing, seller, or buyer is accurate, safe, or legitimate.

To the fullest extent permitted by law, Farmsie is not liable for indirect, incidental, special, consequential, or punitive damages, or for disputes, losses, or damages arising from transactions between users, user content, food safety, or your use of the service. To the extent Farmsie is found liable, our total liability to you is capped at the greater of the fees Farmsie earned on the transaction at issue or US $100.

You agree to indemnify and hold Farmsie harmless from claims, losses, and expenses (including reasonable legal fees) arising out of your listings, sales or purchases, content, food you produce or sell, or your violation of these terms or the law.

(This clause especially will be reviewed by counsel before we rely on it — see the notice at the top.) Except for small-claims matters, disputes between you and Farmsie will be resolved by binding individual arbitration rather than in court, and you and Farmsie waive the right to a jury trial and to participate in a class action. This does not affect disputes between users, which are between those users.

These terms are governed by the laws of the State of South Carolina, USA, without regard to its conflict-of-laws rules. Where arbitration doesn't apply, the state and federal courts located in South Carolina have exclusive jurisdiction.

We may suspend or remove accounts that violate these terms or put other users at risk.

We may update these terms as the product grows. When we make a material change we update the date above and ask you to accept the updated terms before you continue transacting; if you keep using Farmsie after a change, you accept the updated terms.
